Terms and conditions of sale

Article 1 - Scope

These General Terms and Conditions of Sale (GTCS) apply to all orders and all deliveries between Colors and Drops and its customers of the online shop www.colorsanddrops.com

Article 2 - Prices

Our prices are shown in euros, including VAT.

If you order for delivery to a country other than mainland France, you are the importer of the products concerned. Customs duties or other local taxes, import duties or state taxes may be payable. These duties and amounts are outside the responsibility of Colors and Drops. They are payable by you and are your sole responsibility, both for declarations and for payments to the competent authorities and bodies of your country. We advise you to check these points with your local authorities.

All orders, whatever their origin, are payable in euros.

Colors and Drops reserves the right to change its prices at any time, but products will be invoiced at the price in force when the order is confirmed, subject to availability.

Products remain the property of Colors and Drops until the price has been paid in full.

Please note: as soon as you physically take possession of the products ordered, the risks of loss or damage to the products are transferred to you.

Article 3 - Orders

Contractual information is presented in French and will be confirmed at the latest when your order is validated.

Colors and Drops reserves the right not to record a payment and not to confirm an order for any reason whatsoever, in particular in the event of a supply problem or a difficulty with the order received.

Article 4 - Validation of your order

Any order placed on the Colors and Drops website implies acceptance of these General Terms and Conditions. Any order confirmation means your full and complete acceptance of these General Terms and Conditions of Sale, without exception or reservation.

All the data provided and the recorded confirmation will constitute proof of the transaction.

You declare that you are fully aware of them.

The order confirmation will be deemed to be a signature and acceptance of the transactions carried out.

Article 5 - Payment

By validating your order, you undertake to pay the price shown.

Products can be paid for by bank card (CIC Monetico), PayPal or bank transfer. Payment in 4 interest-free instalments is offered with PayPal for purchases from €30, and payment in 3 or 4 instalments by card from €100. Colors and Drops reserves the right to accept only certain types of payment depending on the order or the delivery method chosen by the customer. Payment by cash or cheque is not possible. Payment in instalments via MONETICO commits the consumer to pay the full amount of the order, failing which legal action may be taken.

Payment by bank transfer to our account is possible. The amount is collected before the products are shipped. If the banks charge fees, Colors and Drops reserves the right to pass them on to the customer, especially in the case of unpaid direct debits due to an overdrawn account or incorrect bank details.

Article 6 - Cancellation, withdrawal, exchange or return

An order can no longer be cancelled once its status changes from "payment accepted" to "order in preparation".

Some materials, such as rubber mat, may show slight marks or imperfections on the back of the backdrop. These are inherent to the raw material used and in no way affect the visual appearance or the use of the product on its visible side. They therefore cannot give rise to any exchange, refund or after-sales service claim.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to: the supply of goods made to the consumer's specifications or clearly personalised (backdrops, floors and stands).

At Colors&Drops, each backdrop is made to order according to the size, material and design chosen by the consumer. We therefore do not accept exchanges, refunds or returns.

Products in the Digital category, because of their digital nature and instant download, cannot be refunded or credited under any circumstances.

Some of our designs may have been created digitally with the help of artificial intelligence. This process can leave small artefacts. We check every design and manually correct the main artefacts. Small details that do not affect the overall look of the backdrop may be kept. Please take a close look at the design before validating your order, to make sure you love it 100%. These details cannot give rise to any exchange, refund or after-sales service claim.

Article 7 - Availability

Our products are offered as long as they are visible on the Colors and Drops website and while stocks last (except backdrops and floors).

If a product becomes unavailable after you have placed your order, we will inform you by e-mail. Your order will be cancelled automatically.

Article 8 - Delivery

Products are delivered to the delivery address given during the ordering process, within the time shown on the order confirmation page.

Each backdrop is made to order: allow 10 to 12 working days (excluding weekends and public holidays) between order and delivery. Most orders are processed within 48 hours of payment.

Backdrops and floors are shipped by carrier and delivered without signature. This delivery time may however vary depending on the payment method or carrier chosen, or because of public holidays or other events.

Parcels are suitably sized and your items are properly protected. Vinyl backdrops are shipped rolled. Textile backdrops are shipped folded and protected.

Tracking. As soon as your parcel is shipped, you receive an e-mail with your UPS tracking number and a link to follow your parcel. It is also available in your account, under "My orders".

Absence at delivery. If you are not at home, UPS may leave your parcel at a nearby pick-up point, without always leaving a delivery notice. Follow your parcel so you can collect it in time: it is kept there for 7 days. After this time, it is returned to us, and a new shipment will be charged to you at the current delivery rates.

A problem on receipt? Report it within 7 days of receipt, using the after-sales form on our website (www.colorsanddrops.com/en/sav). Include your order number and photos: each backdrop in full, all the labels on the parcel, the parcel, and a close-up of the problem. For colour issues, add a photo of the whole backdrop with a grey card, taken with a camera and not a phone. This information helps us find a solution quickly and, if needed, make a claim with the carrier or the transport insurance.

Damage caused after receipt (incorrect handling, use, washing, etc.) is not covered. This 7-day period does not affect your statutory guarantees.

If shipment is delayed, we will send you an e-mail to inform you of any impact on the delivery time you were given.

For deliveries by carrier, Colors and Drops cannot be held responsible for late delivery or for the customer's unavailability after several delivery appointments have been offered.

Article 9 - Liability

The products offered comply with the French legislation in force. Colors and Drops cannot be held liable if the legislation of the country where the product is delivered is not complied with. It is your responsibility to check with the local authorities whether the products or services you intend to order may be imported or used.

Furthermore, Colors and Drops cannot be held responsible for damage resulting from misuse of the product purchased.

Finally, Colors and Drops cannot be held liable for any inconvenience or damage inherent to the use of the Internet, in particular a service interruption, an external intrusion or computer viruses.

Subject to the above, Colors and Drops may in no case invoke the guarantee.

Article 10 - Applicable law in the event of disputes

The language of this contract is French. These terms of sale are governed by French law. In the event of a dispute, the French courts shall have sole jurisdiction.

Article 11 - Intellectual property

All elements of the Colors and Drops website are and remain the exclusive intellectual property of Colors and Drops. No one is authorised to reproduce, exploit, redistribute or use in any way whatsoever, even partially, any elements of the website, whether software, visual or sound elements.

All Colors&Drops branded items (backdrops, floors, stands, etc.) are and remain the exclusive intellectual property of Colors and Drops. No one is authorised to reproduce, exploit, rent, redistribute or use them in any way whatsoever.

Article 12 - Personal data

Colors and Drops reserves the right to collect personal information and personal data about you. They are necessary to manage your order and to improve the services and information we send you.

This information and data are also kept for security purposes, in order to comply with legal and regulatory obligations.

In accordance with the amended French Data Protection Act of 6 January 1978 and the General Data Protection Regulation (GDPR), you have the right to access, correct and object to the personal information and data concerning you, directly on the website.

Article 13 - Archiving and proof

Colors and Drops will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with Article 1348 of the French Civil Code.

The computerised records of Colors and Drops will be considered by all parties concerned as proof of the communications, orders, payments and transactions between the parties.
